The following agreement is by and between Mottac Communications ("Mottac.com", "Mottac", Mottac Communication") and the Client

Mottac Communications Acceptable Use Policy and Service Guidelines
Mottac Communications provides web hosting to many clients, and we have a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.

Content:
All services provided by Mottac Communications may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute, and invasion of privacy. The subscriber agrees to indemnify and hold harmless Mottac Communications from any claims resulting from the use of the service, which damages the subscriber or any other party.
All pornographic content and sex-related merchandising is prohibited on all Mottac Communications servers. This includes sites that may infer sexual content or links to adult content elsewhere. Mottac Communications will be the sole arbiter in determining violations of this provision.
Also prohibited are sites that promote any illegal activity or present content that may be damaging to Mottac Communications servers or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:
· Pirated software
· Hacker programs or archives
· Warez sites
Mottac Communications will be the sole arbiter as to what constitutes a violation of this provision.

Clients are responsible for maintaining backups of their content. Mottac Communications will provide a current downloadable backup via the cPanel to assist the client in keeping their backups up-to-date.

In the event that any particular clients' material is not "Server-ready", Mottac Communications may, at its option and at any time, reject this material, including, but not limited to after it has been put on our web servers. This includes Mottac Communication's right to disable such non-"Server-ready" materials, such as CGI scripts or programs which consume an unreasonable amount of CPU (Central Processing Unit) usage or RAM (Random Access Memory) as determined by Mottac Communications. Mottac Communications may also at its discretion at any time, suspend access to any client's website without notice, due to over-consumption of bandwidth (exceeding plan's quota), CPU usage, or any other reason which might effect the performance of Mottac Communications services. Mottac Communications agrees to notify Client immediately of its refusal of the material and/or suspension of the account and afford Client the opportunity to amend or modify the material to satisfy the needs and/or requirements of Mottac Communications. If the Client fails to modify the material, as directed by Mottac Communications, within a reasonable period of time established by Mottac Communications, the Agreement shall be deemed to be terminated.

File Distribution/Mirroring
Mottac Communications forbids use of service for those who provide mirroring service for other website or websites, and/or whose primary purpose is file distribution. Distributions of executable programs, archive files, or other non-visual file types are not welcome. Client's, whose accounts who are found in violation of this policy may, at the discretion of Mottac Communications, have their account(s) terminated without notice.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a Mottac Communications server or using an email address or domain that is maintained on a Mottac Communications machine as reference is STRICTLY prohibited. Mottac Communications will be the sole arbiter as to what constitutes a violation of this provision.

Misuse of System Resources:
Any attempt to undermine or cause harm to a server, or customer, of Mottac Communications is strictly prohibited. This includes, but is not limited to: using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or auto responders other than for the customer's own account; resale of disk space without an appropriate reseller agreement; use of servers for backup of files unrelated to the web site of the account; or resale or remote access to CGI scripts installed on our servers. Operation of IRC servers or IRC bots on our servers will result in an immediate suspension of service.

Financial Arrangements:
1. Client agrees to a minimum one (1) month contract, beginning upon payment.

2. This agreement will automatically renew and be billed for the same successive periods specified by the client on the initial order. This agreement will renew every 1,3, 6, or 12 months unless canceled in writing at least 10 days prior to the renewal date.

Suspension:
Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.

Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
All sub-networks, distributive hosting sites, and dedicated servers of Mottac Communications must adhere to the above policies. Please direct any reports of violations of the above policies to support@mottac.com.
Failure to follow any term or condition will be grounds for immediate account deactivation.
